These Terms of Service ("Terms") govern your use of mytalina.com (the "Store") and your purchase of products from Talina LLC ("Talina", "we", "us"), 8206 Louisiana Blvd NE, Ste A #6686, Albuquerque, NM 87113, United States. By using the Store or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund Policy, which are incorporated by reference. If you do not agree, do not use the Store.
You must be at least 18 years old, or the age of majority where you live, to place an order.
Talina products are cosmetic and personal care products for external use only. They are not drugs or medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. For eye-area products, apply around the eye, not in the eye; if the product gets into your eyes, rinse thoroughly with water. Perform a patch test before first use. Stop use and consult a healthcare professional if irritation or an allergic reaction occurs. If you have sensitive skin, a skin condition or are under medical care, consult a healthcare professional before use. Results and experiences vary from person to person. Product images, including before and after photos shared by customers, are for illustration purposes and individual results may differ.
All orders are subject to acceptance and product availability. We may refuse, limit or cancel any order, including orders that appear to be placed by resellers or that involve suspected fraud. Prices, offers and product descriptions may change without notice. If a pricing or description error occurs, we may cancel the affected order and refund any amount paid. Prices are shown in the currency displayed at checkout.
Payment is due at the time of the order and is processed by third-party payment providers. You confirm that you are authorized to use the payment method you provide.
Our products are shipped from a partner facility located outside the United States. Delivery times, costs, customs and lost package procedures are described in our Shipping Policy. Title and risk of loss pass to you when the carrier marks the package as delivered to the address you provided.
Refunds, including our 100-day money-back guarantee, are governed exclusively by our Refund Policy.
If you submit reviews, photos, comments or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit and publish that content in connection with our business. You confirm that your content is truthful, belongs to you and does not violate any law or third-party right.
All content on the Store is owned by Talina LLC or its licensors. You may not copy, reproduce, modify or use it for commercial purposes without our written permission.
You may not use the Store for any unlawful purpose, to resell our products without authorization, to interfere with the Store's security or operation, to submit false information, or to infringe the rights of others.
Except as expressly stated in our Refund Policy, the Store and all products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, Talina LLC, its members, managers, employees, suppliers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Store or the products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, in which case these limitations apply to the maximum extent permitted by law.
You agree to indemnify and hold harmless Talina LLC and its members, managers, employees, suppliers and partners from any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the products or your violation of any law or third-party right.
Please contact us first at contact@mytalina.com; most concerns can be resolved quickly. If a dispute cannot be resolved informally within 30 days, you and Talina LLC agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. You and Talina LLC waive the right to a jury trial and to participate in any class action, class arbitration or representative proceeding. You may opt out of this arbitration agreement by emailing contact@mytalina.com within 30 days of your first purchase. If this section is found unenforceable, disputes will be heard exclusively in the state or federal courts located in Bernalillo County, New Mexico.
These Terms are governed by the laws of the State of New Mexico and applicable US federal law, without regard to conflict of law rules. Nothing in these Terms limits any mandatory consumer rights you have under the laws of the country where you live.
We may update these Terms at any time by posting a new version on this page. Changes apply to orders placed after the update. If any provision is found invalid, the remaining provisions remain in full effect.
